Questions about Child Support

Since my ex is looking in to having child support raised, because she has taken a job for less money and likes to work only part-time, I went to see my lawyer to prepare for this. My ex is only now moving out and hasn't even gotten the first check yet, so it is a little soon to be asking for a raise in support for a six year old who doesn't consume much.

My lawyer tells me that there is nothing to stop her from asking the court to raise the child support, but she would have to show a major change in circumstances. He feels that a new job may be a major change, but the additional child support would be minor. And as such, he feels a judge would dismiss the motion and tell my ex-wife to wait a little bit and try to get a raise or better job.

That is good.

And as for changing the Parenting Plan (visitation), he says that she would again have to show a major change of circumstances, and there doesn't appear to be one here. So I should be safe with our agreed upon schedule.

He did tell me that he noticed her name on the court's schedule for hearings. I explained that was only because she is already taking the last husband back for more child support. She knows the routine well. But apparently, if you bother the nice judge too many times, he could start to filter your requests and decline your request to see him. I don't know if that will happen, but let's hope so.
